Terms of Service
1. Acceptance of Terms
By accessing or using ProTwin™ (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Your continued use of the Service following any updates to these Terms constitutes your acceptance of the revised Terms.
2. Description of Service
ProTwin™ is a sports statistics entertainment platform operated by ProTwin LLC ("we," "us," or "our"). The Service allows users to enter game statistics and receive a "ProTwin" — a match against historical professional and amateur sports data to find a player whose performance most closely resembles theirs.
ProTwin is designed for entertainment purposes only. Stat matching results are not intended to constitute athletic evaluations, scouting assessments, or professional endorsements of any kind.
3. User Accounts
Account creation and authentication are handled via Clerk. By creating an account, you agree to:
- Provide accurate and complete information during registration
- Maintain the confidentiality of your login credentials
- Accept responsibility for all activity that occurs under your account
- Notify us immediately at support@protwin.app if you suspect unauthorized use of your account
You must be at least 13 years old to use the Service. By creating an account, you represent that you meet this age requirement.
4. Free and Paid Tiers
ProTwin™ offers both free and paid subscription tiers:
- Free Tier: Includes up to 10 stat matches per calendar month. Usage resets at the start of each month.
- Paid Subscription: Unlocks additional matches, features, and premium content. Subscriptions are billed through Stripe on a recurring basis (monthly or annually, as selected).
All subscription purchases are final except where required by applicable law. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of your current billing period. ProTwin LLC reserves the right to modify pricing with advance notice to subscribers.
5. User Content
When you enter game statistics or other content into ProTwin ("User Content"), you grant ProTwin LLC a non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of operating the Service and improving the matching algorithm.
We may use aggregate, anonymized data derived from User Content for product research, performance analytics, and marketing. Individual user data is never sold or disclosed to third parties in identifiable form.
6. Intellectual Property
ProTwin™ is a trademark of ProTwin LLC, pending registration. The name, logo, matching algorithm, historical sports database, app design, and all associated materials are the proprietary intellectual property of ProTwin LLC and are protected by applicable copyright, trademark, and trade secret laws.
You may not copy, reproduce, distribute, reverse engineer, or create derivative works from any part of the Service without prior written consent from ProTwin LLC.
7. Sports Data
Historical sports statistics used in ProTwin are compiled from publicly available sources for entertainment purposes only. ProTwin™ and ProTwin LLC are not affiliated with, endorsed by, or sponsored by any professional sports league, including but not limited to the NBA, MLB, NFL, NHL, or MLS, nor any college athletic program or governing body (e.g., NCAA, NAIA).
Player names and statistics are used under fair use principles for informational and entertainment purposes. Any resemblance to current performance metrics or scouting data is coincidental.
8. College White-Label
ProTwin™ offers a college white-label mode that may display school names, colors, or logos for demonstration and pilot purposes. Such use does not imply an official partnership, endorsement, or license from the institution.
Licensed use of school branding in a production environment requires a formal written partnership agreement between ProTwin LLC and the institution. Schools or athletic programs wishing to enter a licensed partnership should contact support@protwin.app.
9. Limitation of Liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, ProTwin LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to inaccuracies in stat matching results, data loss, or service interruptions. In no event shall ProTwin LLC's total liability exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Indiana.
11. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes via email or an in-app notice. Continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
